LICENSE AGREEMENT

This License Agreement represents an agreement between the end user (hereinafter the Buyer) and the CAR Board (hereinafter the Manufacturer).

This License Agreement represents an agreement between the end user (hereinafter the Buyer) and the CAR Board (hereinafter the Manufacturer).

It is accepted that by continuing the installation of the application, the Buyer accepts the terms of this License Agreement. If the Buyer doesn’t accept the conditions below, they should immediately terminate the installation.

Scope of the Agreement

The software is distributed according to the shareware principle. The Manufacturer shall grant to the Buyer the right to test the software over the period of 30 days from the date of first installation. During this period the Buyer should register the software and pay the license fee. If the Buyer fails to do this within 30 days from the date of first installation, the software will cease to work and the Buyer shall lose the right to test it.

If the Buyer pays the license fee, the Manufacturer shall grant to the Buyer a non-exclusive and non-transferable right to use ArchiveIT! (hereinafter the Software) on one computer (computer workstation) at a time. If the Buyer wants to use the Software simultaneously on more than one computer (workstation), they should purchase a separate license for each workstation.

The Software represents the property of the Manufacturer and, as such both the Software and all accompanying materials thereto, shall be protected by copyright laws of the Republic of Poland, regulations of international conventions and other relevant country laws, as separate subjects of the said laws.

The Buyer has no right to copy, modify, lease, lend, transmit or distribute the Software neither in its entirety nor any part or copy thereof. It is forbidden to make any attempt to read, recompile or use the source codes of the Software.

Limitations of Liability

The Manufacturer has made every effort to ensure that the Software will operate correctly and in accordance with approved assumptions. Nevertheless, the current state of technology does not guarantee that the Software will be totally free of error. The Manufacturer hereby grants a warranty in accordance with existing legal standards. However the said warranty is not related to a totally error-free operation of the Software and, specifically, it is not related to its operation to the complete satisfaction of the Buyer’s requirements or objectives, nor to its compatibility with other software applications or hardware the Buyer may select for use. The Buyer shall be fully responsible for the correct selection of the Software and the consequences of its use, its utility for the specific objectives determined by the Buyer and, at the same time, for the results obtained.

The Manufacturer bears no liability for any loss or damage resulting from the use of or the inability to use the Software, regardless of however the said losses or damages may be incurred and whatever they may be related to, even in the case of notification by the Manufacturer of the possibility of their occurrence.

The Buyer shall bear the whole risk related to the results of the operation of the Software and the use of the Software for a specific purpose. In no case shall the Manufacturer’s liability towards the Buyer exceed the fee paid by the Buyer for using the Software.

Other provisions

Should the Agreement expire for whatever reason, the user must cease to use the software and they are under a strict obligation to remove all remaining Software and parts thereof.

Any Buyer who violates the copyright to the Software shall be subject to civil and criminal liability to the extent determined in the provisions of copyright law.
